1. Agreeing to these terms

These terms are an agreement between you and Gretchen Scalora, a sole trader trading as The Venus Almanac (ABN 21 522 799 850), referred to as "we", "us" or "our". By downloading or using the app or website, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the app.

2. What The Venus Almanac is

The Venus Almanac brings together your menstrual cycle, your birth chart, the Moon and your local weather to give you a daily reading with style, beauty and wellbeing suggestions. It includes horoscopes, a birth chart, cycle estimates, weather forecasts, a Moon diary, personal insights, reminders, a daily star ritual and shareable story cards.

Astrology is offered for inspiration, entertainment and self-reflection. It is not a science, and it should not be the basis for important decisions about your health, money, relationships or safety.

3. Not medical advice

• The Venus Almanac is not a medical device and does not diagnose, treat or prevent any condition.
• Period, fertile window and ovulation dates are estimates based on what you enter. Bodies vary, and these estimates can be wrong.
• Never rely on the app for contraception or to plan or avoid pregnancy.
• Beauty, skin and wellbeing suggestions are general. Check product ingredients and patch-test if you have sensitivities.
• If you have concerns about your health, your cycle or your mood, please talk to a doctor or qualified health professional. In an emergency in Australia, call 000.

4. Who can use the app

You must be at least 16 to use The Venus Almanac. If you are under 18, you need a parent or guardian's permission to buy a subscription.

5. Subscriptions and free trial

• Free trial: new subscribers can try The Venus Almanac free for 7 days. You can only use the free trial once.
• Price: after the trial, the subscription costs A$11.99 a month or A$114.99 a year, including GST. Prices in other countries are shown in the app before you buy.
• Payment: payment is taken through your Apple Account. If you start a free trial, you won't be charged until it ends.
• Automatic renewal: your subscription renews automatically at the end of each month or year, and your Apple Account is charged, unless you cancel at least 24 hours before the end of the current period.
• Cancelling: you can cancel or change your plan any time in your iPhone's Settings, under your name and then Subscriptions. If you cancel, you keep access until the end of the period you've paid for.
• Refunds: payments are handled by Apple, so refund requests go through Apple at reportaproblem.apple.com. This does not affect your rights under Australian Consumer Law.
• Price changes: if we change the price, Apple will tell you in advance, and you can cancel before the new price applies.

6. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those guarantees or any other right you have that cannot lawfully be excluded.

7. Your information and content

Everything you enter, including your logs, diary entries and notes, belongs to you. It is stored on your iPhone, not with us, as explained in our Privacy Policy. This means we cannot recover it if your phone is lost, reset or replaced, or if you delete the app. We recommend backing up your iPhone.

8. Using the app fairly

Please don't:

• copy, resell or redistribute the app or its content, or use it for a commercial service;
• try to reverse engineer, decompile or get around the app's subscription or security features, except where the law allows;
• scrape or bulk-download content; or
• use the app in any way that is unlawful or harms others.

You are welcome to share your story cards on social media for personal use. Please keep the venusalmanac.com mark on them.

9. Our content

The app, website, design, writing, readings, illustrations and the name The Venus Almanac belong to us or are used under licence. Photographs are used under licence from their creators. These terms give you a personal, non-transferable right to use the app on Apple devices you own or control, for as long as you follow these terms.

10. Weather, links and partners

Weather forecasts come from a third-party provider and can be wrong or out of date. Please check official warnings for severe weather.

The app may include links to retailers and other websites, including affiliate links that may earn us a commission. When you buy from a retailer, your purchase is with them and their terms apply. We are not responsible for their products, prices, delivery or websites.

11. Changes and availability

We regularly improve The Venus Almanac and may add, change or remove features. We'll try to keep the app running smoothly, but we can't promise it will always be available or free of errors. If we make important changes to these terms, we will update the effective date and let you know in the app. Continuing to use the app after a change means you accept the updated terms.

12. Our responsibility to you

Subject to section 6 and to the extent the law allows:

• we provide the app's readings, estimates and suggestions as general information, without promising they will be accurate or suit your circumstances;
• we are not responsible for decisions you make based on the app, or for indirect losses such as lost data, lost profits or lost opportunities; and
• where our liability for failing to meet a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.

13. Apple terms

Because The Venus Almanac is distributed through the Apple App Store, these extra terms apply:

• This agreement is between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app fails to meet any applicable warranty, you can notify Apple, and Apple may refund the purchase price. To the extent the law allows, Apple has no other warranty obligation for the app.
• We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else's intellectual property.
• You confirm that you are not located in a country subject to a United States government embargo, and that you are not on any United States government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms, and Apple can enforce them against you.
• You must also follow the terms of any third-party service you use with the app, such as your mobile or internet provider.

14. Ending your use

You can stop using The Venus Almanac at any time by cancelling your subscription and deleting the app. We may suspend or end access if you seriously breach these terms, but we will not do so unfairly, and your rights under Australian Consumer Law still apply.

15. Governing law

These terms are governed by the law of New South Wales, Australia. If you live elsewhere, you also keep any protections your local law gives you.
